1. General

Throughout these Terms of Service (“Terms”), “IONNYK”, “we”, “us” and “our” refer to INKCOMING SA. These Terms govern the use of our website and the purchase of IONNYK products and services through our online store. By accessing our website or placing an order, you agree to these Terms and to the policies referenced herein, including our Privacy Policy, Shipping Policy and Refund Policy. Nothing in these Terms limits any mandatory rights you may have under applicable consumer protection law.
2. Products and Services
IONNYK offers electronic paper digital art frames and related products, content and services.
IONNYK Frames are designed to operate together with the IONNYK application and associated services. Certain functionalities may therefore require an IONNYK account, compatible device and internet connection.
We make reasonable efforts to ensure that product descriptions, specifications, photographs and other information displayed on our website are accurate.
Images and photographs are provided for illustrative purposes. Minor differences may occur due to display settings, materials, manufacturing processes or technical improvements, provided that these do not materially affect the intended use of the product.
We reserve the right to modify, improve or discontinue products or services, subject to applicable law and without affecting orders already accepted by us.
3. Orders
Products displayed on our online store may be added to your cart before proceeding to checkout.
Before confirming your order, you will have the opportunity to review the products selected, prices, applicable taxes, shipping costs and payment information.
An order becomes binding once it has been submitted, payment has been successfully authorized where applicable, and you receive an order confirmation from us.
We reserve the right to refuse or cancel an order for legitimate reasons, including product unavailability, payment failure, suspected fraud, incorrect pricing or other material errors.
If we cancel an order after payment has been received, the amount paid will be refunded.
4. Prices and Payment
Prices displayed on our online store are shown in euros unless otherwise indicated. For consumer purchases within the European Union, prices are displayed including applicable VAT unless clearly stated otherwise. Shipping costs and any other applicable charges are displayed separately before the order is confirmed.
We accept the payment methods displayed during checkout. Available payment methods may vary depending on the customer's country, billing information or other eligibility criteria and may change over time.
Certain payment methods, including deferred or instalment payment solutions, may be provided by independent third-party payment providers and may be subject to their own eligibility requirements and terms.
IONNYK does not charge additional payment-method fees unless expressly disclosed and permitted by applicable law.
5. Shipping and Delivery
Orders are delivered according to the conditions described in our Shipping Policy, which forms part of these Terms.
Estimated delivery times are indicative and may vary depending on the destination, product availability and circumstances outside our reasonable control.
For consumer orders, the risk of loss or damage passes to the customer when the products are physically delivered to the customer or to a third party designated by the customer, in accordance with applicable consumer law.
If a product becomes unavailable after an order has been placed, we will inform you and, where appropriate, offer an alternative delivery date or refund the affected order.
6. Returns and Refunds
Returns, withdrawals and refunds are governed by our Refund Policy, which forms part of these Terms.
IONNYK voluntarily offers a 30-day return period, subject to the conditions set out in that policy.
Consumers within the European Union also benefit from the statutory 14-day right of withdrawal for distance purchases, subject to the exceptions and conditions provided by applicable law.
In the case of a return due solely to a change of mind, return shipping costs are borne by the customer.
Where a product is defective, damaged upon delivery or incorrect, IONNYK will bear the reasonable costs associated with the return or replacement in accordance with applicable law.
7. Legal Guarantee and Warranty
Consumers benefit from the mandatory legal guarantee of conformity provided by applicable consumer law.
For goods purchased by consumers in the European Union, this includes the statutory legal guarantee of conformity applicable in the customer's jurisdiction.
This legal guarantee applies independently of any additional commercial warranty that IONNYK may offer.
The legal guarantee does not cover damage resulting from misuse, accidents, unauthorised modifications or repairs, failure to follow product instructions, exposure to inappropriate environmental conditions, or normal wear and tear where applicable.
Nothing in these Terms excludes or restricts rights granted to consumers by mandatory law.
8. IONNYK Application and Digital Content
Certain IONNYK products and functionalities require the use of the IONNYK application and associated digital services.
The use of the application and certain digital services or content may be governed by additional terms presented to the user when creating an account, activating a service, purchasing digital content or subscribing to a service.
Availability and content of digital services may evolve over time, subject to contractual commitments and applicable law.
9. Artworks and Intellectual Property
The purchase of an IONNYK Frame does not transfer any copyright or other intellectual property rights relating to artworks displayed through IONNYK.
Artworks, photographs and other content available through IONNYK may be protected by copyright and other intellectual property rights belonging to IONNYK, artists, photographers or other rights holders.
Unless expressly stated otherwise, access to such content grants only a personal, non-exclusive and non-transferable right to display it within the IONNYK ecosystem.
Content may not be extracted, copied, reproduced, redistributed, resold, publicly displayed outside the permitted IONNYK environment or used commercially without the authorisation of the relevant rights holder.
The IONNYK name, trademarks, logos, website, application, designs, texts, photographs, graphics and other proprietary content are protected by applicable intellectual property laws.
10. Acceptable Use
You may not use our website, application, products or services:
- for unlawful or fraudulent purposes;
- to infringe intellectual property or other rights;
- to transmit malicious software or interfere with the security or operation of our systems;
- to gain unauthorised access to our products, systems or services;
- to copy, extract or redistribute protected content without authorisation;
- in any manner that violates applicable law or these Terms.
We may restrict access to our services where reasonably necessary to prevent fraud, abuse, security threats or violations of these Terms.
11. Third-Party Services
Certain features of our website or services may rely on third-party providers, including payment, delivery, authentication or other technology providers.
Where you choose to use a third-party service, additional terms and conditions from that provider may apply.
IONNYK is not responsible for third-party services outside its reasonable control, except where responsibility cannot legally be excluded.

The processing of personal data through our website and online store is governed by our Privacy Policy.
Information regarding cookies and similar technologies is available through our privacy and cookie settings.
13. Liability
IONNYK is responsible for the performance of its obligations in accordance with applicable law.
To the maximum extent permitted by law, IONNYK shall not be liable for indirect or unforeseeable losses resulting from the use of our website, products or services.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including mandatory consumer rights.
IONNYK shall not be responsible for delays or failure to perform obligations resulting from circumstances beyond its reasonable control, subject to applicable law.
14. Errors and Availability
We make reasonable efforts to ensure that information displayed on our website is accurate and up to date.
Occasionally, information may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, shipping costs, delivery times or availability.
We may correct such errors and update information at any time.
If a material error affects an order already placed, we will contact you and provide an appropriate solution in accordance with applicable law.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes to our products, services, website, business practices or applicable legal requirements.
The latest version will be published on our website together with its effective date.
Changes will not affect rights and obligations relating to orders concluded before the updated Terms became applicable, unless required by law.
16. Governing Law and Disputes
These Terms and purchases made directly from IONNYK are governed by Belgian law.
If you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protection rights granted by the laws of your country of habitual residence.
In the event of a dispute, we encourage you to contact us first at support@ionnyk.com so that we can attempt to resolve the matter amicably.
Consumers may also have access to competent consumer mediation or Alternative Dispute Resolution mechanisms in their country.
Any dispute that cannot be resolved amicably may be submitted to the competent courts in accordance with applicable law.
17. Severability and Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
These Terms, together with the policies and additional terms expressly referenced herein, constitute the terms applicable to purchases and use of the services covered by them.
